Before you agree

Prelaunch draft — pending insurer and Massachusetts attorney review. The hunt has not started. Signing up does not authorize searching. If this document changes, a new acceptance will be required before participation under the revised terms. This document is not a statement that insurance is bound or that any location is approved.

Organizer and activity

This agreement concerns my voluntary participation in the first Treasure Town treasure hunt in Winthrop, Massachusetts, organized by New England Service Group LLC (the Organizer). The activity may include interpreting clues, walking in permitted outdoor areas and looking for a hidden token. The final start announcement, search boundaries, access restrictions, eligibility and prize-claim rules will be published separately. This waiver does not establish eligibility or guarantee a prize.

Adults and minors

I am at least 18 and sign only for myself. A parent or guardian may subscribe in their own name for updates. This form does not release a child’s claims or approve a child’s participation. Participation by minors requires a separately approved guardian process and final eligibility rules before searching.

Risks I understand

Outdoor searching involves risks including uneven or slippery ground, stairs, trips and falls, roads and traffic, weather, heat or cold, water hazards, plants and insects, other people, and delays in emergency assistance. These risks can cause property damage, serious injury, permanent disability or death. This general list does not identify where the treasure is located. I understand that clues, maps, photographs and cameras are not a safety inspection, supervision or a guarantee of safe access.

My safety responsibilities

I will wait for the official start and follow published rules and posted restrictions. I will not search residential property, trespass, dig, move rocks, disturb vegetation or structures, climb, enter water or approach hazardous edges. I will remain in areas where access and searching are permitted and respect access hours and closures. A clue, photograph or map never grants permission to enter land. I will obey traffic laws, search on foot without distraction, use judgment about my ability and conditions, and stop if conditions are unsafe. For an emergency I will call 911.

Voluntary assumption of risk

I choose whether to participate and may stop at any time. To the extent permitted by Massachusetts law, I knowingly and voluntarily assume the risks associated with my participation, including risks arising from the ordinary negligence of the Released Parties defined below. I do not assume risks that cannot lawfully be assigned to me.

RELEASE OF CLAIMS — INCLUDING ORDINARY NEGLIGENCE

To the fullest extent permitted by Massachusetts law, I release and discharge New England Service Group LLC and its members, managers, employees and authorized volunteers acting in connection with this hunt (the Released Parties) from claims I may have arising from my participation for personal injury, death or property damage, INCLUDING CLAIMS CAUSED BY A RELEASED PARTY’S ORDINARY NEGLIGENCE. This release does not cover gross negligence, reckless or intentional misconduct, or any liability or right that Massachusetts law does not permit me to waive. This agreement does not represent that any town, landowner, sponsor or insurer has approved the event.

Electronic signature and record

By selecting the agreement checkbox, I intend to accept and sign this agreement electronically. I consent to this electronic record and can save or print this page. The Organizer records the submitted email, acceptance wording, server time, document version and document fingerprint. No name is requested for this version. Email confirmation is recorded separately; an unconfirmed submission is not proof of a verified email address. I can contact hello@treasure.town for a copy or to discuss an alternative signing process.

Other terms

Massachusetts law governs this agreement. If a provision is found unenforceable, the remaining provisions apply only to the extent permitted by law. This agreement does not waive rights that cannot legally be waived and does not replace final hunt rules or any land-access requirements. Contact: hello@treasure.town.
